1. General

These Terms & Conditions (“Terms”) govern the access to and use of the website www.gutcultured.com (the “Site”) and the purchase of products offered on it.

The Site is operated by Gutcultured BV (“Gutcultured”, “we”, “us”, “our”). By accessing the Site or placing an order, you agree to be bound by these Terms and Conditions.

Gutcultured BV has its registered office at Kopenhagenstraat 10/102, 9000 Gent, Belgium, registered under 1021.220.651 operating under the trade name “Gutcultured” (hereinafter referred to as “Gutcultured”, “we” or “us”).

3. Products

Gutcultured offers dietary food supplements, including probiotic products or products with live cultures, intended to support general wellbeing as part of a balanced lifestyle.

Our products are dietary supplements, not medicinal products and are not intended to diagnose, treat, cure, or prevent any disease, and do not replace a varied diet or healthy lifestyle.

Consult a healthcare professional if pregnant, breastfeeding, taking medication, or having a medical condition.

4. Availability & Product Information

We strive to ensure product information is accurate. Minor variations or errors may occur. We reserve the right to modify or discontinue products at any time.

5. Orders

Orders are placed via the Site and accepted upon order confirmation email.

We reserve the right to refuse or cancel orders due to availability, errors, or suspected misuse.

6. Prices & Payment

Prices are shown in EUR, VAT included where applicable. Shipping fees are shown at checkout.

Payments are processed securely via third-party payment providers. We do not store payment details.

Shipping terms and fees may differ per region or country.

7. Shipping & Delivery

Shipping terms are described in our Shipping Policy, which forms part of these Terms. Delivery times are indicative and may vary due to external factors.

8. Return, Refund & Withdrawal Policy

8.1 Right of Withdrawal (EU Consumers)

Under EU consumer law, you have the right to withdraw from a distance contract within 14 days without giving any reason, starting from the day you receive the product. This is sometimes called the “cooling-off period”.

To exercise this right, you must notify us of your decision to withdraw within the 14-day period. You must then return the item to us within the next 14 days, unopened and unused. Unless otherwise stated below, legal withdrawal refunds will be processed in accordance with EU law.

8.2 Exceptions Due to Product Nature

Because our products contain live, active probiotic cultures that are sensitive to storage and handling conditions, we do not accept general returns even if the item is unopened. This is necessary to ensure product safety, quality, and efficacy.

Accordingly:

  • Unless a return is specifically approved in writing by us, you may not return probiotic products simply because you change your mind.

  • If you attempt to return an item without prior written approval, it will not be accepted and you will not receive a refund.

8.3 Damaged or Incorrect Goods

If your order arrives damaged or contains the wrong item, please contact us within 14 days of delivery at wecare@gutcultured.com with:

  • Your order number

  • A description of the issue

  • Clear photos showing the damage or incorrect item

Once verified, we will arrange a replacement at no extra cost to you.

8.4 Refunds for Other Concerns (Discretionary)

If you’re not satisfied with your order for another reason, contact our customer care team within 14 days of delivery. While we generally do not accept returns for change-of-mind, in exceptional cases we may, at our sole discretion, authorize a return for inspection before issuing a refund.

If a return is approved:

  • You must ship the product back at your own expense

  • The product must be in original, unopened packaging

  • You must provide a tracking number

  • Returns must be securely packaged in the original shipping box to ensure traceability

After inspection, we will determine whether a refund or replacement is appropriate.

9. Use of the Site

The Website may only be used for lawful purposes. Misuse may result in restricted access.

10. Intellectual Property

All Website content is the intellectual property of Gutcultured or its licensors and may not be used without permission.

11. Liability

To the extent permitted by law, liability is limited to the amount paid for the product and excludes indirect damages.

12. Personal Data

Personal data is processed in accordance with our Privacy Policy.

13. Governing Law & Jurisdiction

These Terms are governed by Belgian law. Belgian courts have jurisdiction unless mandatory law provides otherwise.

14. Changes to These Terms

We may update these Terms from time to time. The latest version is always available on the Website.
